Terms of Service for PixelPlay Arcade

1. ACCEPTANCE OF TERMS

These Terms constitute a legally binding agreement between you and PixelPlay Arcade ("we", "us", "our"). By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. DESCRIPTION OF SERVICE

PixelPlay Arcade is a free-to-play mobile arcade application that provides a collection of mini-games accessible through a vertical-scrolling feed interface. The App is supported by advertisements.

3. AGE REQUIREMENTS

• The App is suitable for all ages.
• Users under the age of 13 must have parental or guardian consent to use the App.
• An age verification gate is presented on first launch to ensure compliance with applicable children's privacy regulations (COPPA).
• For users identified as under 13, personalized advertising is automatically disabled.

4. USER CONDUCT

You agree to use the App only for its intended purpose (entertainment). You agree not to:

• Reverse-engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works based on the App.
• Use the App for any unlawful or unauthorized purpose.
• Attempt to circumvent any security features or ad-serving mechanisms.

5. INTELLECTUAL PROPERTY

All content within the App, including but not limited to game mechanics, graphics, audio, text, and code, is the intellectual property of PixelPlay Arcade and is protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

6. ADVERTISEMENTS

• The App displays interstitial advertisements served by Google AdMob.
• Ads are shown at a controlled frequency (no more than once every 3 game completions, with a minimum 10-minute cooldown between ads).
• We do not control the content of third-party advertisements. If you encounter an ad you believe is inappropriate, please report it via the ad's own reporting mechanism.

7. DISCLAIMER OF WARRANTIES

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free from defects.
• The App will be compatible with all devices or operating system versions.
• Any specific results will be achieved through the use of the App.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our total liability for any claim arising from the use of the App shall not exceed the amount you paid to use the App (which is zero, as the App is free).

9. DATA & PRIVACY

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in our Privacy Policy.

10. MODIFICATIONS TO THE APP & TERMS

• We reserve the right to modify, update, or discontinue the App at any time without prior notice.
• We may update these Terms from time to time. Changes will be effective upon posting the revised Terms. Continued use of the App after changes constitutes acceptance of the modified Terms.

11. TERMINATION

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
