Terms of Service for TorrentMe

1. What the App Is — and Is Not

TorrentMe is a general-purpose client for the open BitTorrent protocol, in the same way a web browser is a general-purpose client for the web. The App:

• hosts no content of any kind;
• provides no search engine, index, directory, feed, or catalogue of torrents;
• does not link to, recommend, promote, or facilitate the discovery of any content.

Every transfer the App performs is initiated by you, using magnet links or torrent files that you choose to add from sources unconnected to us. We have no knowledge of, involvement in, or control over what you transfer.

2. Your Responsibilities

You are solely responsible for the content you download, upload, seed, or otherwise transfer using the App, and for ensuring that you have all necessary rights and permissions to do so. You agree that you will not use the App to:

• infringe any copyright, trademark, or other intellectual-property right;
• obtain, distribute, or share any content that is unlawful in your jurisdiction;
• violate any applicable law, regulation, or third-party right.

BitTorrent is used for entirely lawful purposes every day — distributing open-source software, public-domain media, creative-commons works, datasets, and your own files. Those are the uses the App is built for. Unauthorised sharing of copyrighted material is prohibited by these Terms.

3. No Monitoring; Enforcement

Because the App runs entirely on your device and we operate no servers, we do not and cannot monitor what you transfer. We reserve the right to cooperate with lawful requests from competent authorities. Note that your Internet service provider and rights holders can observe BitTorrent activity associated with your IP address independently of us.

4. Age

You must be old enough to form a binding contract in your jurisdiction (and at least 13 years old) to use the App.

5. Advertising and Purchases

The free version of the App displays advertisements served by Google AdMob. A one-time in-app purchase to remove advertising may be offered; purchases are processed by Google Play and are subject to Google Play's payment and refund policies. Prices may change; already-completed purchases are unaffected by price changes.

6. Intellectual Property

The App, including its code, design, name, and logo, is the property of the Developer and is protected by applicable law. These Terms do not grant you any right to use the Developer's trademarks. You may not copy, modify, distribute, sell, or lease any part of the App except as permitted by law.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA WILL NOT BE LOST.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING WITHOUT LIMITATION ANY CLAIM RELATING TO CONTENT YOU OR OTHERS TRANSFER USING THE BITTORRENT PROTOCOL. TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, THE DEVELOPER'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR £10 IF YOU PAID NOTHING). NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

9. Indemnity

You agree to indemnify and hold harmless the Developer from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) content you transfer using the App; or (c) your breach of these Terms or of any law or third-party right.

10. Termination

You may stop using the App at any time by uninstalling it. We may discontinue the App or any feature at any time. Sections 2, 6, 7, 8, and 9 survive termination.

11. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by an updated effective date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where the mandatory consumer-protection law of your country of residence provides otherwise.
