Terms of Service for OopSafe

Overview

By downloading, installing, or using OopSafe ("the App"), you ("the User", "Parent", "Guardian") agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Description of Service

OopSafe is a child-safe interactive play environment designed for children aged 1-5 under parental supervision. The App provides 16 interactive play modes (drawing, shapes, sounds, words, camera with AR filters, and more) within a PIN-protected lockdown environment that prevents children from exiting or accessing other device functionality without parental authorisation.

2. Intended Use

• The App is intended for use by children under direct parental or guardian supervision
• A parent or legal guardian ("Parent") must complete the initial setup, including creating a 4-digit PIN
• The Parent is solely responsible for supervising the child's use of the device while the App is active
• The App is designed to assist with, not replace, parental supervision
• The App is not a babysitter, childcare tool, or substitute for adult supervision

3. PIN and Access Control

• The App uses a 4-digit PIN to restrict access to settings, configuration, and exit functionality
• The Parent is solely responsible for remembering the PIN
• There is no PIN recovery mechanism. If the PIN is forgotten, the only recovery method is clearing the App's data via Android Settings > Apps > OopSafe > Clear Data, or uninstalling the App. This will permanently delete all saved content (drawings, photos, and settings)
• The App engages device lockdown features (screen pinning, immersive mode, kiosk mode) that may require device-specific steps to override
• The Parent acknowledges that lockdown features vary by device manufacturer and Android version

4. Content and Features

• The App provides interactive play modes including drawing, physics shapes, musical instruments, word learning (ABC, flash cards, categories), bubbles, fireworks, camera with AR face filters, ripples, particles, calm/lullaby mode, and a zen sand garden
• All visual and audio content is generated within the App and is age-appropriate
• Word content is educational (English vocabulary with emoji illustrations)
• All sound is synthesised algorithmically — no external audio is loaded or streamed
• The App is available in 32 languages for parent-facing UI

5. Advertisements

• The App contains advertisements served via Google AdMob
• Advertisements are shown only to Parents after successful PIN verification
• Advertisements are never displayed during children's play activities
• The Parent acknowledges that ad content is served by Google and is subject to Google's advertising policies

6. Camera Usage

• The App includes an optional camera mode featuring augmented reality face filters
• Camera access requires explicit permission grant during setup and can be denied
• If camera permission is denied, the camera mode is hidden and the App functions fully without it
• No photos or video are transmitted from the device
• Face detection runs entirely on-device; no facial data is transmitted or stored
• Photos taken are saved to app-private local storage only

7. Data and Privacy

All data is stored locally on the device. No data is transmitted to external servers (except Google AdMob ad requests, which occur parent-side only). Please refer to our Privacy Policy for full details on data handling, storage, security, and deletion.

8. Device Lockdown Acknowledgement

By using the App, the Parent acknowledges and agrees that:

• The App will attempt to keep the screen on and prevent navigation away from the App
• The App will show over the device lock screen when active
• The App intercepts hardware buttons (home, back, recent apps, volume) to prevent children from exiting
• The App may use Android's Lock Task Mode (kiosk mode) if configured as a device owner
• Device-specific behaviour may vary by manufacturer, Android version, and device configuration
• Standard Android emergency functions (emergency calls, power off via long-press) remain available
• The Parent is responsible for understanding how to exit the App on their specific device
• The developer is not responsible for any inability to exit the App or access other device functions

9. Intellectual Property

The App and its original content, features, functionality, code, and design are owned by Latent Divergence Studios and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• That the App will be error-free, uninterrupted, or free of harmful components
• That the lockdown features will prevent all forms of device access under all conditions
• That the App is compatible with all devices, Android versions, or device configurations
• That saved content (drawings, photos) will be preserved indefinitely
• That the App will function identically across all devices and manufacturers

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LATENT DIVERGENCE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Use of or inability to use the App
• Loss of saved content (drawings, photos, settings)
• Inability to exit the App due to forgotten PIN or device-specific behaviour
• Device-specific compatibility issues or lockdown behaviour
• Interruptions caused by phone calls, system updates, or other system-level events
• Any unauthorised access to or alteration of locally stored data
• Any conduct or content of any third party in connection with the App
• Ad content served by Google AdMob

12. Indemnification

You agree to indemnify and hold harmless Latent Divergence Studios, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App or violation of these Terms.

13. Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to download, install, and configure the App. The App is designed for children to use under the supervision of a qualifying adult.

14. Termination

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for any reason. Upon termination, all locally stored data remains on the device until manually deleted.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be reflected in the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Latent Divergence Studios regarding the App.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
